Conditions Of Use

Panasonic Electric Works Sales Middle East FZE ("PEWSME") has established these Conditions Of Use for users of PEWSME Home Page (PEWSME Home Page and other home pages under the name of Panasonic Electric Works Co., Ltd., (Panasonic EW.)'s divisional companies). By using this Home Page, you signify your assent to these Conditions Of Use. PEWSME may modify these Conditions Of Use. The modified version of these Conditions Of Use will appear on this Home Page so please confirm the contents of the renewed version each time. Your use of this Home Page constitutes your assent to such modifications. If you breach any of these Conditions Of Use, you are required to rectify such breach as instructed by PEWSME.

1. Definitions

a) The term "Contents" as used herein shall mean any contents that appear on PEWSME Home Page, including any writings, catch phrases, logos, trademarks, service marks, company names, photographs, illustrations, graphs, drawings, reflections, animation, still pictures, music, sounds, software, computer programs, data base, data, etc.

b) The term "Your Computer" as used herein shall mean a single computer currently used by you to view PEWSME Home Page.

2. Permissible Range of Use

2-1.You may view and print the Contents provided by PEWSME on Your Computer for your personal use. Please note that some Contents cannot be printed.

2-2. You may download the Contents that are not restricted by PEWSME on Your Computer for your personal use. If separate terms of use apply to such Contents, please observe such terms.

2-3.With respect to the Contents and PEWSME Home Page, without PEWSME’s prior consent, you are prohibited from using the Contents in any manner not stipulated in paragraphs 2-1 and 2-2 above or performing any other act, including, but not limited to, reproduction, modification, reverse engineering, distribution, transmission, transferring, leasing, licensing, exporting, business activities or use for profit-making purpose.

3. Link

3-1. When setting up a link to PEWSME Home Page, if the link will have the entire display on the screen jump to the URL pages listed below, no notice to PEWSME is needed but you need to observe the terms of these Conditions Of Use and any others that are stipulated.

These URL pages are subject to modifications without any advance notice. PEWSME will not be held responsible for any damages incurred by you from such modifications.

3-2. Please use PEWSME's company name written in ordinary letters for the link button. You may not use PEWSME's logos, trademarks, etc.

3-3. You are prohibited to set up a link using frames or a link that could mislead all or a part of the Contents to be of a party other than PEWSME.

3-4. PEWSME may reject you from setting up a link if PEWSME judges that the contents of your home page are against public order and morals or invite other problems.

3-5. Any third party's Web site linked to or from PEWSME Home Page is strictly under the control and responsibility of such third party. PEWSME shall have no responsibility to the contents of such Web site. Furthermore, the existence of such link shall not be deemed as PEWSME's recommendation of such third party's Web site or its contents.

4. Prohibitions

In addition to the prohibitions stated above, the following activities are prohibited:
a) Violation of PEWSME or any third party's properties, rights, privacy, honor, trust, interests, etc.;
b) Use, transmission or uploading of harmful computer programs, data or information;
c) Interference of PEWSME & Panasonic EW.'s operation of PEWSME Home Page;
d) Infringement of laws or legally binding regulations;
e) Any act against public order and morals;
f) Any act that may correspond or similar to each of the above prohibitions; or
g) In addition to the above, any act judged by PEWSME as inappropriate

5. Modification of PEWSME Home Page and Contents

Please note that PEWSME Home Page and Contents are subject to modification or deletion by PEWSME without any advance notice.

6. Comments to PEWSME

If you have any comments, inquiries, etc., regarding PEWSME, please forward them to PEWSME. However, please refrain from sending us any of your or third party's trade secrets, exclusive information, any ideas or names for new products or any other suggestions, materials or creative ideas (hereinafter collectively called the "Ideas") except those specifically requested by PEWSME on certain occasions. None of the Ideas sent to PEWSME without PEWSME's request shall be subject to any obligation of use, compensation or confidence by PEWSME. The sender of such Ideas shall be deemed to have waived any and all rights to such Ideas, including, but not limited to know-how right, copyright, industrial property rights, etc. If PEWSME specifically seeks certain Ideas to the public, such Ideas will be handled in accordance with the arrangements made by PEWSME at that time.

7. Limitation of Liability

7-1.In using PEWSME Home Page and Contents, defects such as character deformation in the text, data omission, errors or interruption may occur due to various conditions of use. Under no circumstances shall PEWSME be liable for any direct, indirect, incidental, consequential or special damages that result from such defects or from the use of or the inability to use PEWSME Home Page or Contents that are in such defective state.

7-2. PEWSME is making its best efforts in its operation of PEWSME Home Page, but PEWSME makes no legal warranty or bear any legal obligations or responsibility with respect to the accuracy or usefulness of the Contents.

8. Governing Law and Court of Competent Jurisdiction

The use of PEWSME Home Page and construction of these Conditions Of Use shall be governed by and interpreted in accordance with the laws of United Arab Emirates. The local court of Dubai shall be named as the agreed exclusive court of jurisdiction for the first hearing of any disputes arising in connection with the use of PEWSME Home Page.
